Construction Site Accidents
Construction workers are the backbone of our society, and without construction workers, simply put, life as we know it would be entirely different. Construction workers are responsible for building our towers, stores, offices, and homes from the ground up, and our firm recognizes that we owe a great debt to construction workers in Toronto and throughout Ontario.
That being said, construction is a comparatively dangerous field of work, and when supervisors or other parties are negligent, construction sites can become all the more dangerous. Some of the most common causes and types of construction site accidents that our firm sees are as follows:
Structural collapses
Electrocutions
Trench cave-ins
Explosions
Multi-story falls
Trip/slip & fall accidents
Ladder accidents
Chemical burns
Injuries due to falling debris
Defective scaffolding accidents
The bottom line is that if you've been injured in a construction site accident, Merricks Law Group has your back. We know how hard you work, and we will not let a work-related injury take that away from you. Our Toronto personal injury lawyers are ready to help.
WSIB Benefits
When someone is injured on the job in Ontario, they will typically seek benefits through the Workplace Safety and Insurance Board, or WSIB. WSIB is a form of no-fault insurance designed to help employees financially, covering things like a portion of lost income and medical/rehabilitation costs, until they are physically capable of returning to the workforce once again. In exchange for these guaranteed, no-fault benefits, workers generally cannot sue their own employer or co-workers for a workplace injury.

Third-Party Claims
Unfortunately, there are times where WSIB benefits simply do not cover the entire cost of a work-related injury, particularly non-monetary losses like pain and suffering. When this happens, workers may be entitled to file what is known as a third-party claim, provided their injury was caused by someone other than their own employer or a co-worker. In a third-party claim, our firm will seek to hold that liable third party accountable for your injury.
For example, we may file a claim against an independent contractor, a negligent product designer/manufacturer, a liable property owner, or any other outside party that may be responsible for your injuries. In some cases, Ontario law allows you to elect between accepting WSIB benefits or pursuing a lawsuit against a negligent third party, so it's important to speak with a lawyer before making that decision, as it can significantly affect the compensation available to you.
